Terms of Use for the Application Programming Interface (API) of DonDominio / MrDomain

These Terms of Use for the Application Programming Interface (API) of DonDominio / MrDomain ("API Terms") establish the clauses and conditions of use for the DonDominio / MrDomain API.

The DonDominio / MrDomain API is a service owned by Soluciones Corporativas IP, S.L., (hereinafter, DonDominio / MrDomain) that is provided through the website www.dondominio.com / www.mrdomain.com and made available to third parties to use the application. Access and interaction of any kind with the DonDominio / MrDomain API imply acceptance of the terms established in these conditions.

If the person (licensee, in these terms) who is going to use the DonDominio / MrDomain API does not agree with these terms, they do not have DonDominio / MrDomain's authorization to use its API.

DonDominio / MrDomain reserves the right to modify, at any time, and with a maximum notice of 10 days, the conditions established in this agreement. Prior Registration.- If you wish to use the DonDominio / MrDomain API, you must first register or be a client of DonDominio / MrDomain. To do this, you must complete the DonDominio / MrDomain API access request form and provide us with the necessary contact information. The form is available on the DonDominio / MrDomain Website (the "Registration"). By registering at DonDominio / MrDomain and/or using the DonDominio / MrDomain API, you explicitly agree to comply with these API Terms, as well as any revised or new versions that are published on www.DonDominio.com / www.MrDomain.com or that DonDominio / MrDomain may notify you by other means. DonDominio / MrDomain reserves the right, at its sole discretion, to reject or deny your registration.

Access to the DonDominio / MrDomain API.- It is an essential requirement to be able to make requests to the DonDominio / MrDomain API to have a DonDominio / MrDomain client account and be authenticated as a user in the service.

In addition to the above, the user must have at least five (5) active domains accessible in their client account, or pay in advance the amount of fifty (50) euros, which will appear as a balance in the client's account who wishes to use the API.

License of use.- DonDominio / MrDomain grants the licensee a license under the framework of the Consolidated Text of the Spanish Intellectual Property Law. The license is non-exclusive, non-transferable, non-sublicensable, and revocable, for a worldwide geographical scope to use the DonDominio / MrDomain API and other materials provided by DonDominio / MrDomain (referred to as "API" for the purposes of these terms) for the regular management of a portfolio of domains (registration, transfers, inquiries, modifications, etc.) and other services (SSL certificates, web hosting, etc).

The use of the API for concurrent or bulk inquiries for commercial or big-data purposes is not allowed and may result in the loss of the use license and the indefinite blocking of access to the API. This license does not grant you any rights with respect to version improvements or updates nor does it guarantee the continuous availability of the API.

This license does NOT cover or allow the commercial use of the API, the distribution or resale of access to it, or in any way allow access to the Service by a third party, compile or use information obtained through the API for direct marketing, sending spam, or other unsolicited communications, use the API in a way that violates the law, perform reverse engineering or attempt to gain unauthorized access to the API, use it to introduce into our systems viruses, software locks, worms, trojans, or other devices or code intended to delete, disable, deactivate or interfere with or otherwise harm any software, program, data, device, system or service, or intended to provide unauthorized access or produce unauthorized modifications.

Use

API Call Limits.- There is a limit of concurrent connections per IP and/or request rate per hours on some commands that will be determined by DonDominio / MrDomain at any time. DonDominio / MrDomain may discretionarily limit, and without prior notice, the number of requests to the API that the licensee can make at any time. DonDominio / MrDomain will determine these limits based on technical factors such as the volume of application use or the load that the servers may be supporting at any time. The user must respect these ratios to avoid the global malfunction of the system.
Effective Use of the API.- The user agrees to make effective use of the DonDominio / MrDomain API under the terms indicated in these conditions. Not using the API for a 12-month period or using it solely to obtain data (availability or WHOIS queries) during this period, without having made any domain registration, renewal, or transfer, may result in DonDominio / MrDomain warning the user of this lack of effective use. After this warning and, if the user continues not to make effective use of the API, DonDominio / MrDomain may proceed to deactivate access to the API. This definitive deactivation will not involve the return of any amount that the user has previously paid to DonDominio / MrDomain for API use.

The use of the DonDominio / MrDomain API for purposes contrary to law, morality, or public order is expressly prohibited, as is performing any action that may cause any kind of damage to DonDominio / MrDomain or its users or third parties. The user may not use the DonDominio / MrDomain API in a way that directly or indirectly violates any law or intellectual property rights. This includes laws and intellectual property rights of Spain as well as other countries.

Purposes (API functionality).- The use of the API is intended for the regular management of a portfolio of domains (registration, transfers, inquiries, modifications, etc.), as well as other services offered by DonDominio / MrDomain to its clients (SSL certificates, web hosting, etc).

The use of the API for concurrent or bulk inquiries for commercial or big-data purposes is not allowed and may lead to indefinite access blocking.

Effectiveness of actions carried out through the API.- The use of the DonDominio / MrDomain API by the client means that all actions that it performs through it will be executed by the systems of DonDominio / MrDomain in real-time, in the same way, as if these instructions were processed on the DonDominio / MrDomain website, and thus cannot be invalidated once executed.

The instructions or information requests made through the API will be executed by DonDominio / MrDomain regardless of who performs them. Consequently, the client will be solely responsible for the actions or instructions made through the API concerning the domains managed by the client. Therefore, the client must safeguard their systems to prevent unauthorized access, intrusions, or third-party uses that could compromise the management of their domains as well as the integrity of DonDominio / MrDomain's systems.

In this regard, the client will be responsible for taking the necessary security measures to prevent API access by third parties without their authorization and to maintain the security and integrity of the access credentials.

Intellectual and Industrial Property Rights.- DonDominio / MrDomain is the owner of all rights to the Service, including the API, technology, and software that we use to provide the API and the Service. All trademarks, logos, icons, graphics, designs, text, or other content of the Service are our property or the property of our licensors, and they are protected by copyright, trademark, and other intellectual property rights.

Access to the API does not authorize the client to use the logos and/or trademarks of DonDominio / MrDomain, as well as those of the Registries or associated companies, except with express written consent from DonDominio / MrDomain and/or the third-party companies that own the trademarks.

Limitation of Liability.- DonDominio / MrDomain will not be liable for any direct, indirect, consequential, or secondary damages unless the damage is directly attributable to DonDominio / MrDomain.

The client agrees to hold harmless and indemnify DonDominio / MrDomain, its subsidiaries, agents, and employees, advertisers, or partners, against any claim from the client or a third party arising from the use of the DonDominio / MrDomain API, including any claim or expense arising from any claim, loss, damage (present or consequential), demands, legal costs, professional fees, of any kind and nature.

Warranties.- DonDominio / MrDomain guarantees that it is the owner of its API. DonDominio / MrDomain guarantees the operation of its API, provided it is correctly used and installed by the client following DonDominio / MrDomain's instructions. DonDominio / MrDomain does not guarantee that the operation of the DonDominio / MrDomain API is reliable, accurate, complete, or valid in all cases.

DonDominio / MrDomain does not guarantee the reliability, accuracy, and quality of the products, services, information, or any other material obtained through the DonDominio / MrDomain API.

The DonDominio / MrDomain API is supplied as is. DonDominio / MrDomain expressly disclaims any warranty of any kind, express or implied. The client uses the DonDominio / MrDomain API at their sole risk and under their exclusive responsibility. The client will be solely responsible for any damages caused by using the DonDominio / MrDomain API, including, among others, any damages or data losses in their computer equipment.

Duration and Termination.- These Terms of Use will come into effect at the time the application author first uses the DonDominio / MrDomain API and will remain in effect until terminated by either party.

DonDominio / MrDomain may at any time modify, suspend, or terminate the application of these Terms of Use and, therefore, the availability of the DonDominio / MrDomain API. Additionally, DonDominio / MrDomain will have the right, at its sole discretion, to terminate, at any time, the application of these Terms of Use for a specific user.

Either Party may terminate these Terms of Use at any time and for any reason.

Language.- The full text of these Terms of Use has been drafted in Spanish and English, with both versions being considered official, although the Spanish version is set as the priority for interpretation.

Applicable Law.- These Terms of Use, as well as the relationship between the client and DonDominio / MrDomain, will be governed and interpreted in accordance with Spanish law. In the event of any claim, demand, or disagreement arising from the application or interpretation of these Terms of Use, both parties, waiving any other jurisdiction that may be competent, agree to submit the dispute to the exclusive jurisdiction of the courts of Manacor (Mallorca).
